Judiciary Switch-hitting

Mission: Shades of Gray
Location: Chief Security and Tactical Officer's Office

Ensign Stran entered the Chief Security and Tactical Officer's office, in proper dress uniform.

"Ensign Stran, I appreciate you arriving on time for your appointed Administrative review, however, upon discussing it, with Captain York, you have been pardoned of all charges." Cassandra Levue said, from across the desk.

"Forgive me, I do not wish to misunderstand you." Stran said. "You are saying that I am thus, fit for active duty, yet do not have any assigned tasks, or duties?"

Cassandra Levue wondered where this was going. "That's correct."

"Next question. What of Ensign Daniel Daniels?" Stran asked. Demanded could be used, a bit more appropriately.

"Ensign Daniel Daniels is pending administrative, judicial, and psychiatric review, relieved of all duties, and restricted to the brig." Cassandra Levue said, watching the Vulcan carefully. This seemed to be unfolding like a very cleverly thought out, impromptu game, of Klin Zha.

"Very well. I hereby assert my authority as Ensign Daniel Daniels' JAG Lawyer, as there are no other appropriately trained individuals currently capable of standing in this position, due to medical requirements. Ensign Daniels' Administrative review will begin now. This requires the presence of an assistant Chief Security and Tactical Officer, which, is currently listed as Ensign Daniels. As he has been relieved of all duties, you are required, by regulations, to appoint one, until such time, that either Ensign Daniels can resume his duties, or be replaced. Ensign Daniels is also required to be present, as are any, and all, of his accusers." Stran said, in a calm, clipped voice. He stood straight, at attention, and with a completely unreadable face on.

He'd be good at poker. If this is a bluff, I'd like to see his hand, regardless, at this point. Cassandra thought to herself. "Levue to Brig Officer on duty, please bring Ensign Daniels to my office."

"Aye ma'am."

"Levue to Ensign Maddison Tyler. You are hereby assigned as temporary assistant Chief Security and tactical officer. A matter has arisen in my office, that requires your presence, in my office, now." Levue added, switching her com-links.

"I'll be there shortly, ma'am."

"Deputy Marshal Donovan to the Chief Security and Tactical Officer's office, immediately." Levue added, after hitting her com-badge again.

Stran stood, at attention, in full dress uniform. Ensigns M. Tyler, and D. Daniels were also present, in normal uniform.

Deputy Marshal Donovan was standing, in a somewhat relaxed position, in a civilian jump-suit.

Levue looked at the four, from across her desk. "This is an administrative review of the report, submitted by then-under cover SCIS Internal Affairs officer Deputy Marshal Janine Donovan, as to the conduct, and report, of Ensign Daniel Daniels." Levue said. She was about to continue, but was interrupted.

"Not Ensign Stran?" Donovan demanded.

"Deputy Marshal Donovan, this is an official proceeding. You will await your turn to speak. The Administrative review of Ensign Stran, and any restrictions to his duties, have been overridden by the Commanding Officer, Captain Samantha York." Levue said, with a scowl directed at Donovan.

Donovan could not handle Levue's glare for long. Levue knew that, too, as she had served under her, until two years ago, aboard a different ship.

"Present, are the accused, Ensign Daniel Daniels, and his acting JAG Attorney, Ensign Stran." Levue said.

Daniels looked sharply, at Stran, but said nothing. He simply nodded.

"Representing the SCIS, is Deputy Marshal Donovan, acting Supervisory Agent Afloat. Officiating Officer, is Lieutenant Junior Grade Cassandra Levue, with Ensign Maddison Tyler, acting assistant Chief Security and Tactical Officer moderating." Levue finished.

Donovan looked clearly unimpressed with this.

"Recording, for judiciary purposes." Maddison said, bringing a PADD around the room. "Please place your hand on the PADD, to confirm your consent to this."

All officers did, as requested.

"The Charges against Ensign Daniel Daniels, are, dereliction of duty, and conduct unbecoming a Starfleet Officer." Lieutenant Junior Grade Levue started. "Ensign Stran, how does your client plead?"

"Not guilty, by means of improper investigation." Stran said, in a clipped tone, that sounded slightly unimpressed with having his hand forced into taking this option.

"HOW DARE YOU!" Donovan exclaimed.

"Ensign Stran, that is a dangerous accusation. Are you officially filing counter charges against the SCIS Supervisory agent, for failure to properly investigate this case?" Levue asked.

Stran shook his head.

"Then what are you saying?" Levue asked.

"I am stating that the SCIS Supervisory agent should neither have been investigating this case, nor should she currently be acting as Supervisory agent." Stran said, calmly.

"WHAT?" Donovan demanded.

"Ensign Stran, would you clarify this?" Levue asked.

"Permission to begin questioning the Supervisory Agent, and presenting the Defence of my client, ma'am?" Stran asked.

"Out of turn, but I've already read the prosecuting side's report. We'll accept that as the Prosecution's case. Do you have anything case-related, to add, Miss Donovan?" Levue asked.

"No, Miss Levue." Donovan said, scowling very deeply at Stran.

"Miss Donovan, this is a formal administrative review of Ensign Daniel Daniels, and, now, yourself. You will address each officer, but appropriate rank, and, specifically, refer to myself as Lieutenant Levue, or ma'am, is this clear?" Levue demanded.

"Yes, ma'am." Donovan said, shocked by the harsh tone of Levue's voice.

"Good. Ensign Stran, you may proceed." Levue stated.

"In 2386, Then-field agent Donovan was ordered to take 1 year's psychiatric leave, and continue to receive psychiatric care, and treatment, for the following 2 years. As the officer who ordered this, is conveniently present, then assistant Chief Security and Tactical Officer of the USS Arizona, Lieutenant Junior Grade Levue, we do not require a recess to await this officer's testimony. Was this order issued, Lieutenant Levue?" Stran asked.

"Yes, it was." Levue said, wondering where Stran was going with this.

"We are still within the later half of that 2 year period, and yet, there are no Medical, nor Psychiatric reports of Deputy Field Marshal Donovan on file, aboard the USS Calypso. As she has been assigned to the USS Calypso for 9 weeks, 3 days, and fourteen point two one seven hours, this is a violation of the terms of her return to active duty, and is also against several Starfleet Regulations. I will now pause my argument, to permit Deputy Field Marshal Donovan to dispute, or rebuke this statement." Stran said, calmly.

"HOW DARE YOU!" Donovan yelled. "I'VE BEEN BUSY DETERMINING WHETHER OR NOT YOUR DEPARTMENT HAS TO BE-"

Stran interrupted. "Deputy Field Marshal Donovan does not have anything pertinent to the case to interject with. The fact remains, that Deputy Field Marshal Donovan was remiss, in her duties, and has failed to report for a Crew physical, as required by any officer, or civilian, serving in a security position, aboard a Starfleet Vessel. She is also in remiss of required psychiatric care. Do you believe my assumptions to be made correct?" Stran asked.

"If that is true," Levue said, as she tapped a few commands into her console, "Which the computer confirms, then yes, you are correct, Ensign."

"Therefore, for 9 weeks, 3 days, and fourteen point two one eight hours, Deputy Field Marshal Donovan has been illegally investigating the Security Department of the USS Calypso. Therefore, all evidence, as well as any reports, or orders issued because of said reports, are null, and void, and not legally admissable, in either a Federation Civilian Court, or a JAG Investigation. Is this not correct, according to regulations, Lieutenant Junior Grade Levue?" Stran asked.

Daniels darted his attention, which had been riveted on Stran, to Levue.

"Yes, it is." Levue said, eyeing both the Vulcan, and Daniels, carefully.

"In that event, the defence rests it's case." Stran said. He took a step back, falling into line with Daniels.

"Ensign Stran, may I ask why you have not reported Deputy Field Marshal Donovan, prior to this event, for being remiss in her duties?" Levue asked.

"I was not aware of it, prior to this point." Stran said. "This was originally my defense case. I spent three hours, using a sickbay monitor, to collect the required information."

Levue studied Stran closely. Whether lying, or not, it was a plausible enough excuse.

"Deputy Field Marshal Donovan, you are hereby relieved of all improperly assigned duties." Levue said. "And, for forcing both the Chief Security and Tactical Officer, and Commanding Officer, through an unnecessary administrative review of a technically innocent Ensign, who holds assistant department head level authority, you are restricted to the brig, except for medical and psychiatric reviews, which will begin, immediately. Do you understand me?"

Donovan did not look at any of them. She'd been defeated. Clearly. Cleanly. She was not going to give any of them the look of pure devastation on her face. It was, instead, obscured by her hair. She said nothing.

"Miss Donovan, this is an official administrative review. You will respond directly to all questions, audibly, so they may be recorded, for clerical reasons, or face insubordination charges." Levue said, curtly.

"Yes, ma'am. I understand you." Donovan said, softly.

"Technically, Lieutenant Levue, Deputy Field Marshal Donovan is a civilian. You cannot charge her with insubordination." Maddison Tyler said quietly.

"To the contrary, Ensign Tyler, Deputy Field Marshal Donovan is a Civilian Authority directly answering to the Chief Security and Tactical Officer, of her post. As such, should Deputy Field Marshal Donovan be insubordinate, according to uniform military law, as she is acting as a military officer, she is permissable to be charged, under uniform military code, which includes insubordination charges." Stran said, in direct response.

"Don't argue with Ensign Regulationpedia." Daniels said, with a chuckle, a sense of humor finally filling him with the desire to laugh about something. "He can quote you the line, and page number, of the regulation book. Try him."

"Thank you, Ensign Stran. Ensign Daniels, during official proceedings please refrain from commentary." Levue said, somewhat distraught about being either tricked into restraining someone under false pretenses, or letting someone off, under technicalities.

"Yes ma'am." Daniels said sharply.

"Good. Ensign Daniel Daniel Daniels, you are hereby reinstated as Assistant Chief Security and Tactical Officer, with all the rights, priveleges, and access levels granted to such a position. Official apologies are hereby issued, on my behalf, and that of Captain Samantha York, who, for the record, did not seem to believe that you were guilty of any crime, a sign, I admittedly missed, which should have spoken of your composure. Upon review of the reports, you are the closest thing to an Acting Chief Security Officer this vessel has had in some time, and it would be my honor, to have you serve in the Assistant Chief position, until such time you either succeed me, or find an appropriate transfer to another Chief Security and Tactical Position. Do you accept this request?" Levue asked.

"Of course, ma'am. No hard feelings. You are just doing your job, after all. It'll be nice serving under someone who does that." Daniels said, with a bit of a chuckle.

"That's a thin-ice comment, Ensign Daniels. You've been found not guilty of these charges, by technicality. Do not add fuel to any future investigations, and do not abuse this second chance I am giving you. This review is now concluded. Ensign Tyler will escort Deputy Marshal Donovan to the brig." Levue said. "Ensign Daniels, Ensign Stran, you are dismissed."

"Yes ma'am." Tyler said.

Daniels and Stran, both, simply nodded, and left the room, falling in step.

"You got any of those fancy Vulcan sayings, to explain this, Stran?" Daniels asked, as they left the door.

Stran nodded. "A wise man, once said, on a regular basis, that there are always possibilities."

Daniels chuckled. "Close enough. Close enough."

Levue smiled, slightly, as she watched the four leave. She pulled up the inter-departmental memo system, and logged a simple note to the Commanding Officer.

Disregard all files, regarding any judicial, psychiatric, or administrative reviews, of Ensign Daniel Daniels was all that it read.
